Leasehold Enfranchisement is the process to either extend your lease or purchase a share of the Freehold. The Leasehold Reform, Housing & Urban Development Act 1993 (as amended) (LRHUDA 1993), gives long Leaseholders of flats the eligibility to enfranchise their lease.
This starts by the Leaseholder commissioning a valuation of the flat and then a Section 13 (S13) Notice is prepared by a chosen solicitor and is served on the Freeholder. This forms an “offer” to the Freeholder, to which they must respond within a two month period, with a Section 15 (S15) Counter Notice. If no response is received within this time frame, then the offer on the S13 Notice is deemed accepted.
To qualify for collective enfranchisement, the main requirements are:
If the Freeholder’s solicitor serves a S15 Counter Notice, each party has six months from the date of the counter notice must either reach an agreement, refer the matter to the First-Tier Property Tribunal for negotiation or the process will have to begin all over again.
Whether you are a Leaseholder looking to enfranchise your property or a Freeholder who has been served a S13 Notice.
