Leasehold Enfranchisement and Negotiations

Leasehold Enfranchisement is the process to either extend your lease or purchase a share of the Freehold. The Leasehold Reform, Housing & Urban Development Act 1993 (as amended) (LRHUDA 1993), gives long Leaseholders of flats the eligibility to enfranchise their lease.

This starts by the Leaseholder commissioning a valuation of the flat and then a Section 13 (S13) Notice is prepared by a chosen solicitor and is served on the Freeholder. This forms an “offer” to the Freeholder, to which they must respond within a two month period, with a Section 15 (S15) Counter Notice. If no response is received within this time frame, then the offer on the S13 Notice is deemed accepted.
